Belgian payroll withholding tax

More control over payroll costs.
More room to grow.

Is your company using its R&D and shift-work withholding tax exemptions correctly and fully? FuturePath connects the relevant activities, statutory conditions and payroll figures.

For Belgian SMEs and larger businesses

Your activities deserve
a precise assessment.

A new lab, additional shifts or a growing engineering team changes your organisation. FuturePath examines what this means for your payroll withholding tax, what information is missing and which next step is justified.

Focused expertise

Two areas.
A clear benefit from precision.

The conditions differ. We assess each regime against its own facts, calculation basis and evidence.

01 / SHIFT WORK

Start with the shop floor.

For businesses with successive shifts, night work or continuous production. The actual work organisation determines which regime is relevant.

22.8%Base rate on qualifying taxable remuneration; 25% for continuous work.
01 / SHIFT WORK

What needs to align?

  • Schedules, shift staffing and actual daily work
  • Nature and volume of the work in each shift
  • Shift or night premiums and the one-third rule
  • Taxable remuneration and available withholding tax

Weekend work alone does not establish a separate entitlement. The shift-work bis regime needs a specific assessment.

02 / RESEARCH & DEVELOPMENT

From research to substantiation.

For businesses carrying out R&D with qualifying researchers. Technical complexity alone does not establish the exemption.

80%Of actual withholding tax attributable to qualifying R&D activities.
02 / RESEARCH & DEVELOPMENT

What makes a file complete?

  • Substantive definition of projects and programmes
  • Timely BELSPO notification before the start
  • Qualifying degrees and documented R&D time
  • Reconciliation of activities, employees and payroll

Additional caps apply to certain bachelors. Assessment is by activity, employee and period.

The base rates are not percentages of total payroll cost. Statutory correction factors apply from 2027; the calculator shows their impact.

RESEARCH & DEVELOPMENT · ARTICLE 275³ BITC 92

Which activities qualify as research and development?

Three project categories defined under Belgian law. An innovative activity or R&D job title alone does not establish eligibility.

01 / 03

Fundamental research

Generating new knowledge about underlying phenomena, without a direct practical application in view.

What does this mean for your project?

What new scientific knowledge is the project seeking?

02 / 03

Industrial research

Planned or critical research to gain knowledge for new or substantially improved products, processes or services.

What does this mean for your project?

What technical advance or substantial improvement is being pursued?

03 / 03

Experimental development

Combining and applying existing knowledge to design new or improved products, processes or services.

What does this mean for your project?

Which designs or experiments test the proposed development?

What must be evidenced?

Project content and objective · timely BELSPO notification · eligible employees · actual qualifying R&D time · payroll and withholding tax.

Routine changes do not automatically qualify. Since 1 August 2023, a new BELSPO notification must precede the project start. Notification alone is not a tax approval.

FuturePath · 2026

A first indication. No payroll data required.

Three choices show an illustrative scale. Actual relief requires evidence and payroll review.

How is this calculated?

Assumptions: 12 months; R&D: 70% qualifying research time with fictional withholding of 25–32% of gross pay; shift/continuous: 80% qualifying activity, taxable earnings approximated by the selected monthly salary and a fictional payroll withholding ceiling. Eligibility, exclusions and interactions require review; actual withholding comes from payroll.

Legal adjustment: 2027 97%, 2028 93.35%, from 2029 95.9%; not applied to 2026 illustrations.

Before your first conversation

Which opportunities deserve a closer look?

Why review the current and following payroll years?

Statutory correction factors change from 2027. Review current payroll application and supporting evidence together with forward planning.

Will we receive the full savings analysis at the first meeting?

No. The first call scopes feasibility. A company-specific assessment, evidence and implementation advice belong to a separately agreed paid engagement.

Our payroll partner already applies an exemption. Is a call worthwhile?

It may be. The first question is what is already applied, for which employees and on what evidence. Existing use does not automatically imply additional scope; completeness and traceability also matter.

What should I prepare for the exploratory call?

A short description of your activities, teams, shift organisation or R&D projects and current approach. Individual payslips are not needed for this first conversation. Confidential documents are shared only through an agreed process.

Do all technical roles or bachelors qualify as R&D automatically?

No. The activity and project or programme must qualify in substance. Degrees, time allocation and timely notification must align. Only certain bachelor degrees qualify and additional caps apply.

Can shift work and R&D be added together?

Not without checking. Cumulation rules, employee allocation and available withholding tax must first be assessed. The calculator therefore considers one regime and one defined population per calculation.

Does an indication guarantee savings or a retrospective claim?

No. An indication is arithmetic. Facts, qualification, evidence, filing periods and applicable time limits determine what can actually be applied. The risk of adjustment, recovery and interest is part of that assessment.

From indication to insight

A first conversation defines the question. A focused diagnostic supports the answer.

From an initial indication to a documented decision. No individual payroll records are required for the first call.

Discuss your activities, eligible groups and current approach at a high level. No personal payslips.

02 · Scoped diagnostic

We agree the scope, required evidence and fee before confidential file review or disclosure of company-specific findings.

03 · Confidential execution

Once agreed, we establish appropriate NDA, access and use rights, and deliver an evidence-based assessment and next steps.
